tekahchip — Terms of Use

1. Acceptance

By downloading, installing, or using tekahchip, you agree to these Terms of Use. If you don't agree, please don't use the app. These terms are between you and Hello Good Day ("we," "us," or "our").

2. The Service

tekahchip is a native iOS running coach. It plays short audio tones over your music at run milestones — each mile or kilometer, pace shifts, heart-rate zones — and tracks your distance, pace, and route by GPS. Completed runs are saved to Apple Health. The app supports Live Activities, the Dynamic Island, Apple Watch heart rate, and Game Center leaderboards and achievements.

tekahchip is a consumer fitness app. It is not a medical device, not a diagnostic tool, and not a replacement for professional advice from a doctor, coach, or trainer.

3. Health and Safety Disclaimer

Please read this section carefully.

• tekahchip is not medical advice. Nothing the app shows or says is a substitute for guidance from a licensed healthcare provider. If you have any condition that might affect your ability to exercise — including heart, lung, joint, or metabolic conditions, pregnancy, or recent surgery — talk to your doctor before starting a running program.
• Numbers are estimates. Distance, pace, calorie burn, and heart-rate zones are estimates based on GPS, your Apple Watch, and the information you provide. They are not lab-accurate measurements.
• Stay aware of your surroundings. tekahchip's audio cues are designed to be brief, but you should still set your volume so you can hear traffic and other hazards. Be especially careful when running on roads, on shared paths, or at night.
• You are responsible for your own safety. You decide when, where, and how hard to run. We are not responsible for injuries, accidents, or health events that occur during or after use of the app.

4. License to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use tekahchip on iOS devices you own or control, for your personal, non-commercial use. Apple's standard App Store End User License Agreement (the "Licensed Application End User License Agreement") also applies to your use of the app — you can read it at apple.com/legal/internet-services/itunes/dev/stdeula. Where Apple's EULA and these terms conflict, the more user-protective term applies.

5. Acceptable Use

Please don't:

• Reverse engineer, decompile, or disassemble the app, except where applicable law expressly permits it.
• Use the app for any unlawful purpose or in a way that interferes with other users' enjoyment of Apple Health or Game Center.
• Attempt to gain access to the app's source code, signing keys, or development tools.
• Submit fraudulent scores or achievements to Game Center using the app. (Apple's Game Center terms also apply here.)

6. Apple Health and Game Center

Your use of Apple Health within tekahchip is also governed by Apple's terms and privacy practices for Apple Health. Your participation in Game Center is governed by Apple's Game Center terms. We don't operate either service and don't control how Apple handles your data within them. If you have a question about Apple Health data or a Game Center account, please contact Apple directly.

7. Disclaimer of Warranties

tekahchip is provided "as is" and "as available." We don't promise that the app will be uninterrupted, error-free, or always available. We don't warrant that pace, distance, route, calorie, or heart-rate readings will be accurate in any specific situation — they depend on your hardware, GPS signal, and the information available to the app.

To the fullest extent allowed by law, we disclaim all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the fullest extent allowed by law, Hello Good Day and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of tekahchip, including any injury, illness, lost data, or loss of opportunity. Our total liability for any claim related to the app is limited to the greater of (a) the amount you paid for the app in the twelve months before the claim, or (b) $50.

Some jurisdictions don't allow these limits, so parts of this section may not apply to you.

9. Termination

You can stop using tekahchip at any time by deleting it from your device. We may discontinue or change the app — or any feature in it — at any time without notice. If we discontinue the app entirely, your locally stored runs remain on your device (and in Apple Health) and are still yours.

10. Governing Law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute that isn't required to go to arbitration under applicable law will be brought in the state or federal courts located in the State of Florida, and you and we agree to that venue.

11. Changes to These Terms

We may update these terms from time to time. When we do, we'll change the "Last updated" date above and post the new version at the same URL. If a change is material, we'll also call it out in the app's release notes. Your continued use of tekahchip after the change means you accept the new terms.
