These Terms of Use ("Terms") govern your use of the Earbeats iOS application ("Earbeats" or "the App"), published by Hello Good Day ("we," "us," or "our"). By downloading, installing, or using Earbeats, you agree to these Terms. If you do not agree, do not use Earbeats.
Hello Good Day grants you a limited, non-exclusive, non-transferable, revocable license to install and use Earbeats on Apple devices you own or control, solely for personal, non-commercial use. The App is licensed, not sold. All rights not expressly granted are reserved.
You may not:
You acquire Earbeats through the Apple App Store. Your use of Earbeats is also subject to the Apple Media Services Terms and Conditions and Apple's Licensed Application End User License Agreement, except where they conflict with these Terms. Apple is a third-party beneficiary of these Terms and may enforce them against you.
Earbeats is free to download and includes a free trial of Earbeats Pro lasting ten (10) days from first launch. After the trial, continued use of Earbeats Pro requires one of the following In-App Purchases through the Apple App Store:
com.hellogoodday.earbeat.lifetime. A one-time non-consumable purchase priced at US$14.99 (or local equivalent). No recurring charges. Tied to your Apple ID; restorable via the "Restore Purchase" control in the App.com.hellogoodday.earbeat.monthly. An auto-renewing subscription priced at US$2.99 per month (or local equivalent). Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless auto-renew is turned off at least twenty-four (24) hours before the end of the current period. Your account is charged for renewal within twenty-four (24) hours prior to the end of the current period at the price shown above. You may manage your subscription and turn off auto-renewal at any time in your Apple ID Account Settings or at https://apps.apple.com/account/subscriptions.If you purchase the Lifetime option after starting a Monthly subscription, please cancel the Monthly subscription separately in your Apple ID Account Settings to stop further charges.
All pricing is shown in US dollars unless otherwise noted; Apple converts to local currency in each App Store storefront and may adjust the local price equivalent. Hello Good Day does not collect or store payment information; all billing is handled by Apple under the Apple Media Services Terms and Conditions.
Earbeats is a wellness and fitness tool, not a medical device. Heart-rate readings displayed by Earbeats come from sensors in Apple AirPods Pro 3 and are intended for informational purposes only.
Earbeats is not designed, intended, or approved to diagnose, treat, cure, mitigate, or prevent any disease or medical condition. Do not rely on Earbeats for medical decisions. If you have any health concerns or symptoms, consult a licensed medical professional. Do not use Earbeats as a substitute for medical advice, diagnosis, or treatment.
Earbeats is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by Florida law, Hello Good Day disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, and any warranties arising from a course of dealing, usage, or trade practice.
We do not warrant that Earbeats will be uninterrupted, error-free, secure, or compatible with future versions of iOS, AirPods Pro 3, or other Apple hardware or software.
To the maximum extent permitted by Florida law, in no event shall Hello Good Day be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from or relating to your use of Earbeats, even if advised of the possibility of such damages.
Our total cumulative liability to you for all claims relating to Earbeats shall not exceed the amount you paid for the App, if any, or fifteen U.S. dollars (US$15.00), whichever is greater.
We may suspend or terminate your access to Earbeats at any time if you materially breach these Terms. You may stop using Earbeats at any time by deleting it from your device. Termination does not entitle you to a refund.
We may update these Terms from time to time. The "Effective Date" above will reflect the date of the latest version. Material changes will be communicated through an in-app notice or by updating the App Store description. Your continued use of Earbeats after a change constitutes acceptance of the updated Terms.
These Terms, and any dispute arising from or relating to Earbeats, are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute shall be brought exclusively in a state or federal court located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of such courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If any provision of these Terms is held to be invalid or unenforceable under Florida law, the remaining provisions remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hello Good Day regarding Earbeats and supersede any prior agreements.
